ElecQUA Co., Ltd. Terms of Use for Location-Based Services

Article 1 Purpose

These Terms establish the rights, obligations, and responsibilities of ElecQUA Co., Ltd. (hereinafter referred to as the Company) and users in connection with use of the location-based weather-information service provided by the Company through the ElecQUA application.

Article 2 Service Description and Fees

  1. The Company retrieves nearby weather information based on the User’s approximate location and displays it in the App.
  2. The App does not directly use the smartphone’s GPS or continuously track precise location.
  3. Use of this Service is free of charge. However, the User is responsible for data communication charges under the User’s agreement with their telecommunications provider.

Article 3 Use and Retention Period of Personal Location Information

  1. The Company uses approximate location information only when retrieving weather information.
  2. Approximate location information is transmitted to AccuWeather Intl., LLC, and nearby weather information is returned to the App.
  3. The Company does not store approximate location information. Pursuant to Article 16 (2) of the ACT ON THE PROTECTION AND USE OF LOCATION INFORMATION, the Company automatically records data confirming the use and provision of location information and retains it for up to three years.

Article 4 User Rights

  1. Users may withhold all or part of their consent to the use of personal location information or withdraw that consent at any time.
  2. Users may request the temporary suspension of the use of personal location information.
  3. Users may request access to or notification of records confirming the use and provision of their location information or correction of errors in those records.
  4. If the User withdraws consent or refuses the use of location information, the weather-information feature cannot be used, but the product’s other features remain available.
  5. Use of location information may be suspended by disabling location permission for the ElecQUA App in the smartphone settings. Requests to access or receive notification of records confirming use and provision, or to correct errors in those records, may be submitted using the contact information in Article 9.

Article 5 Provision to Third Parties

With the User’s consent, the Company provides approximate location information overseas to AccuWeather Intl., LLC for the provision of weather information. The Company does not otherwise provide a User’s personal location information to third parties.

Article 6 Age Restriction on Registration

Persons under 14 years of age may not register for the Service.

Article 7 Modification and Suspension of the Service

The Company may modify or suspend all or part of the Service due to maintenance, a failure, modification or suspension of the external weather service, or force majeure.

Article 8 Compensation for Damage and Disclaimer

  1. If damage occurs because the Company violates applicable laws and regulations or through the Company’s intent or negligence, the Company bears responsibility in accordance with applicable laws and regulations.
  2. The Company is not liable for damage caused by a communications failure, an external weather-service failure, a cause attributable to the User, or force majeure where the Company has neither intent nor negligence.
  3. Weather information consists of observation and forecast data from an external provider and may differ from actual weather conditions.

Article 10 Governing Law and Dispute Resolution

These Terms are governed by the laws and regulations of the Republic of Korea. If a dispute arises, the court having jurisdiction over the Paju area will be the court of first instance.

Article 11 Matters Not Provided for in These Terms

Matters not provided for in these Terms are governed by applicable laws and regulations, including the ACT ON THE PROTECTION AND USE OF LOCATION INFORMATION, and by the Company’s Terms of Use for ElecQUA Services and Privacy Policy.

Addendum

These Terms take effect on September 13, 2026.
